Practice notes
Michel heads the competition & regulatory practice and is an active member of the Eversheds Sutherland Energy group. He is specialised in EU, anti-trust, commercial and energy law and has a special focus on energy transition and renewable energy projects. Michel advises both national and international clients, as well as governmental bodies and utilities. He has a wide experience in dealing with utility companies with public shareholders and the specific complexities around decision making processes of municipalities. Michel is admitted to practice law in the Netherlands. He holds a degree from Leiden University in Netherlands, International Public and European law and spent two years working in the EU (energy) law practice in Brussels. Michel is frequently asked to speak on energy conferences, seminars and courses. He also sits on the supervisory board of AEC, the advisory board of Solease and is a member of the legal and tax committee of the trade association Holland Solar.
Relevant experience includes advising:
- A public private partnership set up to realize the largest ground mounted solar energy project in the Netherlands in 2015. Michel acted as a member of the steering committee and was involved in all stages of the project as lead counsel.
- The Municipality of Tilburg on the procurement of large roof mounted solar energy installations for a large number of schools and municipality buildings. As lead counsel Michel was responsible for the design and execution of the entire procurement process.
- The Enterprise Agency of the Ministry of Economic Affairs on the issue of awarding (state owned) locations for renewable energy projects to private initiatives. This resulted in a study involving key stakeholders like the Ministry of Infrastructure’s department responsible for managing state properties including highways and waterways, as well as the association of municipalities and the energy cooperatives sector.
- A large international solar developer on their development portfolio for groundmounted solar parks up to 100 MW.
- One of the largest international renewable energy utilities on agreements for large ground mounted and roof mounted solar projects.
- a US listed company on an international anti-trust investigation in the industrial battery sector. This includes dawn raid assistance, leniency applications and legal proceedings involving national competition authorities.
- a market leader in the maritime sector active on the towage market on an international antitrust and merger control clearance following an international joint venture.
- advise an energy service company on agreements for a complex combined heat project involving a privately operated grid for transport of heat.
Awards and rankings:
• As of 1995 Michel is a lawyer and has been recommended by Legal 500 and Chambers Legal. In the 2019 Legal500 edition Michel was recommended for Competition, Energy Transactional and Energy Regulatory.

Michel is partner bij Eversheds Sutherland en leidt de praktijkgroep Mededinging en Economisch Ordeningsrecht. Hij heeft ruime ervaring in de sectoren energie & utilities, gezondheidszorg, woningcorporaties en retail.
Michel adviseert nationale en internationale ondernemingen, alsmede overheden en instellingen in de publieke sector.
Michel is verbonden geweest aan het Internationaal Instituut voor Energierecht te Leiden en aan de Europese Commissie, DG voor Energie. Michel is een veel gevraagd spreker voor congressen, seminars en opleidingen.
Voorbeelden van recent werk:
- Kartelonderzoeken: begeleiden van ondernemingen die voorwerp zijn van een kartelonderzoek van de mededingingsautoriteiten. Ondersteuning bij invallen, clementieverzoeken en procedure bij de mededingingsautoriteiten.
- Innovatieve prestatiecontracten in de gezondheidssector: Begeleiding van ziekenhuizen bij de totstandkoming van een Technologisch Partnershap Overeenkomst met betrekking tot de levering en onderhoud van medische apparatuur, producten en diensten.
- Realisatie zonne-energie projecten: begeleiden investeerders in het grootste zonnepark van Nederland op Ameland; begeleiden aanbestedingen voor grootschalige zone-energie installaties op daken van scholen, gemeenten en bedrijven.
- Impact gewijzigde Woningwet: adviseren van corporaties en verbonden ondernemingen over de gevolgen van de gewijzigde Woningwet.
- Openen winkelketens: begeleiden van grote buitenlandse retailketens bij het opzetten van Nederlandse activiteiten.
