Practice notes

Nicola is a Principal Associate in our Commercial Dispute Resolution team in London. Nicola advises on a range of disputes and has particular experience in high-value and cross-border disputes arising out of commercial contracts, issuing applications for urgent injunctive relief (and the subsequent progression of cases on a speedy trial timetable), warranty and indemnity disputes and enforcement of restrictive covenants of senior individuals. Nicola has particular expertise in managing large-scale disclosure exercises.

Nicola works across sectors including the Transport, Energy and Health and Life Sciences sectors.

Nicola's recent work includes:

  • Acting for a high profile private equity investor in relation to its multi-million pound warranty and indemnity claims against the seller and guarantor under a share purchase agreement. Our investigations resulted in our client amending its case to include a claim for fraud;
  • Preparing injunction applications, including applications to restrain significant strike action proposed across the UK in the Transport sector, to enforce post-termination restrictions in employment contracts of former senior employees, to prevent the threatened infringement of trade marks and to prevent the publication of a disputed higher education assessment report;
  • Successfully defending an action in the Chancery Division under an exclusive trade mark licence agreement between a leading UK health retailer and a US-based retailer of sports nutrition products;
  • Acting for a joint venture energy company in respect of a High Court claim arising from the installation of offshore wind turbines;
  • Advising employers on matters including a judicial review claim brought by a former employee, the enforcement of restrictive covenants in employees' contracts of employment and the enforcement of Employment Tribunal judgments.

Nicola also has significant experience of working on regulatory investigations in the Financial Services sector. She has worked on a number of the largest investigations conducted by the firm, including an investigation into the potential mis-selling of derivative products and an investigation on behalf of a major financial institution and the FCA. Nicola has completed a secondment to the Litigation and Regulatory Enforcement team at a leading international bank.
