Practice notes
Alastair is a partner in our litigation and dispute management group. He handles a broad range of commercial disputes while specialising in banking, finance and professional negligence litigation.
His experience includes defending a claim brought against a major clearing bank for damages based on reliance on a letter provided by the bank as to the solvency of a potential tenant. The tenant proved insolvent and the pursuer was left with a significant seven figure fit out bill and arrears of rent. The claim was successful defended in both the Outer House and on appeal. (Reported Case, [2011] CSOH 129 and [2013] CSIH 12). He was also instructed by the Administrators of a high street Building Society to review their commercial loan book in relation to numerous of professional negligence claims relating to property valuations which were relied upon for lending decisions. The claims involved the valuation of over 100 properties and all resulted in positive settlements. He has also acted for numerous asset financers in recovery of assets and enforcement of personal guarantees.
Alastair has been recognised by Legal 500 as “knowledgeable”, and “engenders confidence” in the field of professional negligence.
He has written articles on Auditors Liability, Identity Fraud and the threat of fraud to business in Scotland for both the Herald and Scotsman newspapers.
Alastair is a regular Speaker at conferences and training seminars and is also a member of The Law Society of Scotland Insurance Committee; CBI Consumer Affairs Panel; Fraud Advisory Panel; and Fraud Lawyers Association.
