Andrew is a principal associate in our commercial practice and is based in the Abu Dhabi office. Andrew focusses on TMT and IP matters across the MENA region. Andrew has over 10 years’ experience of contentious and non-contentious IT and IP work, including transactional work and significant IP litigation in the UK Court of Appeal, High Court and IPEC. Typical areas of IP advice include IT procurement contracts, commercialization agreements, trade mark and patent licenses, IP assignments and due diligence on IP matters (in particular software, OSS and escrow due diligence).
Andrew's non-contentious work includes acting for a MENA government entity on a comprehensive IP review of an online regulatory and service portal; acting for a major Middle Eastern bank on its IT acquisition contracts; advising a global software supplier on its Middle East commercial activities; acting for a major Middle East telecoms company on a strategic IT system supply contract; acting for a US based international software company in the difficult and long running negotiation of a trade mark co-existence agreement with a UK-headquartered software company relating to a core brand of both parties; advising a major US company in the oil exploration sector on a complex IP licence; and advertising advice to major retailers, including advertising clearance advice, and advice on the CAP Code and ASA complaints.
Andrew's contentious work includes acting for the UK Intellectual Property Office in successful court proceedings for trade mark infringement and passing off in relation to renewal reminder scams; acting for a hi-tech manufacturer in a successful claim in relation to electronic circuit design and software, against both one of its former designers and a competitor company, which involved unregistered design right and copyright infringement and a dispute over ownership of those rights; acting for a major European retailer in a reported case involving complex trade mark license issues; advising a UK manufacturer on a number of patent and design right claims and providing it with patent clearance advice; and brand enforcement for major international brands, including action against the online sale of counterfeit products.
Andrew holds the Diploma in IP Law and Practice from Bristol University.
