Dr. Johannes Grooterhorst is an Of Counsel at Eversheds Sutherland in Dusseldorf and a founding partner of the previous law firm Grooterhorst & Partner. On 01 August 2017, the previous law firm Grooterhorst & Partner became part of the Dusseldorf office of Eversheds Sutherland.

Johannes has more than 30 years' experience in real estate law. He accompanies large project developments in particular in the area of planning law, provides complex advice to significant portfolio holders, private investors, institutional investors and asset managers, in particular regarding restructurings, planning law matters, commercial tenancy law matters, the drafting of service contracts (asset, facility and center management) and in the area of private construction and architect law. His advice in the area of public law includes inter alia immission protection law as well as contamination matters.

He provides corporate law advice in the areas of foundations of companies, restructurings as well as company disputes in particular of large family companies and – due to his long-time involvement as a lawyer in the ARAG/Garmenbeck D&O liability case – the handling of D&O cases with respect to claims for coverage and damages. Johannes also has extensive experience in the area of the law of associations and foundations, inter alia based on designing such entities and the long-standing litigation of the leading case regarding reach-through liability within entire associations. In addition, he is a renowned litigator in commercial law disputes and an arbitrator in such proceedings.

Johannes inter alia is a long-standing advisory board member of the German Council of Shopping Centers, the European Legal Group of the ICSC, the Trade and Municipal Affairs Committee of the Central Committee of the Real Estate Industry (Ausschuss Handel und Kommunales des Zentralen Ausschusses der Immobilienwirtschaft, ZIA) and the German Institution of Arbitration (Deutsche Institution für Schiedsgerichtsbarkeit, DIS) as well as Compliance Officer of the Initiative of Corporate Governance of the German Real Estate Industry (Initiative der Corporate Governance der deutschen Immobilienwirtschaft e. V., ICG). Furthermore, he is a member of Industrie-Club Dusseldorf, UIA, co-leader of the forum law/architecture/project development (Forum RAP – Recht / Architektur / Projektentwicklung), the society for environmental law (Gesellschaft für Umweltrecht e.V.), legal advisor of crenet as well as a member of the legal committee of the Dusseldorf Chamber of Commerce and Industry.

Johannes studied law at the Universities of Münster and Lausanne (Switzerland) and at the Faculté Internationale de Droit Comparé in Strasbourg. In 1986, he completed his doctoral thesis and was awarded the title of Dr. jur.. In 1985 and 1986, he was a research assistant at the central institute for spatial planning at the University of Münster and a research associate at the faculty for spatial planning and public law (Prof. Dr. Werner Hoppe).

Since April 1986, he has been working as a commercial lawyer in Dusseldorf. Between 1989 and 1994 he was a partner of a renowned commercial law firm. On 01 August 1994, he founded the law firm Grooterhorst & Partner. Since 01 August 2017, he has been a Partner at Eversheds Sutherland and the manager of the office in Düsseldorf.

Johannes is regularly named in the JUVE Handbook. In addition, the Best Lawyers count him among the leading real estate lawyers in Germany. He received the university award of Westfälische Wilhelms-University of Münster and the research award of the Foundation of German Cities, Communities, and Districts for the Promotion of Municipal Sciences.

Johannes' recent experience includes:

  • Establishment of the planning law for CentrO Oberhausen and its extension (2005)
  • Establishment of the planning law for the factory outlet center in Ochtrup/Westphalia
  • Long-time legal advice in the ARAG/Garmenbeck D&O liability case
  • Assisting the restructuring of the German activities of a European steel group
