Penelope is a Legal Director of our dedicated Privacy, Data Protection and Information Law team where she specialises in providing Data Protection advice (including the General Data Protection Regulation (GDPR), Data Protection Act 2018, and the laws regarding Privacy and Electronic Communications), as well as advising on the Freedom of Information Act (FOIA) and Environmental Information Regulations (EIR). Penelope has experience working in various different sectors, including the: public sector, diversified industrials, TMT, Financial Institutions, and Consumer sectors (amongst others).
Penelope's detailed understanding of data protection law and the GDPR has helped her provide not only technical advice on the application of the law, but also strategic advice on the possible implications of the GDPR for clients so that they can consider how best to approach their GDPR compliance projects. Penelope has advised clients on various issues regarding data sharing and data storage issues whether with other third parties, or intra-group arrangements for multi-national organisations. She regularly advises and assists clients respond to complaints to the UK’s Information Commissioner’s Office, and has assisted clients respond to data security breaches, including multi-jurisdictional breaches, as well as breaches involving engagement with multiple regulators. Given her experience in dealing with the ICO, and data security breaches, Penelope is one of the Eversheds Sutherland data breach “first responders”, meaning that she is one of the first people on the initial calls with clients when a data security breach is identified and clients are trying to assess what course of action to take and what their first stems should be.
Penelope has worked for both public and private sector clients and thus has a good understanding of the expectations on both sides of the coin, particularly where this relates to FOIA and/or EIR matters. As one of our specialists in FOIA and EIR, Penelope has advised clients not only on the drafting of FOIA/EIR clauses, but also the approach to take in relation to compliance with the FOIA and EIR, advice and support to clients in responding to requests for information under these regimes from the initial request response stage, all the way to assisting with appeals to the Information Tribunal.
