Practice notes

Nicola Wessely is a Principal Associate in our Litigation and Dispute Management practice group and a member of the Global insurance sector group. Nicola specializes in advising clients on the interface of (product) liability and product conformity and insurance law. She regularly advises companies and insurers on the enforcement of claims in connection with product defects or damage events and the defense against such claims.

Nicola enjoys winning for clients, but having advised and represented clients for almost 10 years now in legal disputes before the German civil courts, in complex cross-border legal disputes as well as in national and international arbitration proceedings, she also knows and appreciates that settling matters amicably in out-of-court negotiations in many cases can also be in the client's best interest. Furthermore, Nicola advises on general questions in insurance and Insurance contract and insurance supervision law and commercial law matters. .

Nicola is a member of DIS40 (German Initiative of Young Arbitrators (Deutsche Initiative junger Schiedsrechtler)) of the German Institution of Arbitration (Deutsche Institution für Schiedsgerichtsbarkeit e.V., DIS) as well as a member of the German-British Lawyers' Association (Deutsch-Britische Juristenvereinigung e.V.).

Nicola studied law at Humboldt University in Berlin. During her studies, she obtained the "Certificate of Advanced Study and Training in Dispute Resolution" of the Tulane University School of Law (New Orleans, Louisiana) and the Institute of Law Governing the Legal Profession (Institut für Anwaltsrecht) at Humboldt University in Berlin. Before she joined Eversheds Sutherland, Nicola worked for an international law firm in Düsseldorf as well as for various law firms in Frankfurt am Main.

Nicola's recent experience includes advising:

  • Advising two suppliers in the field of high-pressure cleaning technology against US American customer and end users of product as well other companies in connection with product liability proceedings in the US based on an alleged product defect
  • International lead on advising an air conditioning supplier in a Europe-wide recall of heat pumps, including communication with authorities and customers
  • Representation of an automotive supplier in negotiations on recall costs after worldwide recall vis-à-vis OEM and insurer
  • A multinational corporation in the transport sector in DIS arbitration proceedings regarding rights of recourse of a consortium partner due to alleged construction defects
  • An international fan manufacturer in independent proceedings for the taking of evidence regarding alleged claims for defects and compensation after an accident in a wind channel
  • Advising a retail company on the structuring of the mediation of supplementary insurance products in Germany and France
