Practice notes

Nicola Wessely is a Principal Associate in our Litigation and Dispute Management practice group.

She has experience in advising and representing clients within the framework of legal disputes before the German civil courts, in particular in the areas of product liability law and product conformity. She regularly advises companies on the enforcement of claims in connection with product defects or damage events and the defence against such claims. Furthermore, Nicola advises on general commercial law matters. She advises international companies in complex cross-border legal disputes as well as in national and international arbitration proceedings.

Nicola is a member of DIS40 (German Initiative of Young Arbitrators (Deutsche Initiative junger Schiedsrechtler)) of the German Institution of Arbitration (Deutsche Institution für Schiedsgerichtsbarkeit e.V., DIS) as well as a member of the German-British Lawyers' Association (Deutsch-Britische Juristenvereinigung e.V.).

Nicola studied law at Humboldt University in Berlin. During her studies, she obtained the "Certificate of Advanced Study and Training in Dispute Resolution" of the Tulane University School of Law (New Orleans, Louisiana) and the Institute of Law Governing the Legal Profession (Institut für Anwaltsrecht) at Humboldt University in Berlin. During her legal traineeship, Nicola worked for an international law firm in London. Before she joined Eversheds Sutherland, Nicola worked for an international law firm in Düsseldorf as well as for various law firms in Frankfurt am Main.

Nicola's recent experience includes advising:

  • A Dutch SPV in court proceedings against a contractual partner regarding claims and rights in connection with an exposure to asbestos in the headquarters of a leading real estate business
  • A multinational corporation in the transport sector in DIS arbitration proceedings regarding rights of recourse of a consortium partner due to alleged construction defects
  • A turbine manufacturer in independent proceedings for the taking of evidence, inter alia in respect of the non-achievement of the agreed production capacity
  • An international fan manufacturer in independent proceedings for the taking of evidence regarding alleged claims for defects and compensation after an accident in a wind channel
