Practice notes

Stefan is partner at Eversheds Sutherland in Munich and one of the three members of the law firm's management committee. Furthermore he heads the German Employment and Labour Law practice group.

He mainly advises employers in labour law matters. He regularly provides legal support to DAX, MDAX and Tec-DAX companies as well as to numerous medium-sized companies.

Stefan has profound know-how in all areas of labour law, in particular in terms of representing employers on restructurings, regarding works constitutional matters (reconciliation of interests and social plan), disputes on collective agreements, providing legal support in collective bargaining negotiations as well as in procedures concerning individual employment law. He furthermore focuses on advising executive bodies of corporations (management board, supervisory board and managing directors) and providing legal support with regard to legal aspects under service, liability and criminal law.

In addition, he regularly publishes contributions to labour law topics, inter alia, as co-publisher of a commentary on the German Employee Inventions Act (ArbnErfG).

Stefan's recent experience includes:

  • Representation of an employers' association with respect to services of general interest with the purpose of preventing warning strikes of the ver.di trade union
  • Representation of a manager in labour and criminal law matters through all instances to the German Constitutional Court leading to successful constitutional complaints
  • Accompanying comprehensive business reorganisations and restructurings including negotiations on reconciliation of interests, social plan and social collective agreement
  • Advising a private bank on the adjustment of the company pension scheme


Awards

JUVE handbook 2012/2013 lists Stefan as a frequently recommended lawyer. Moreover, JUVE states: "Kursawe furthermore focuses on advising senior executives (both sides)."
The latest edition of "European Legal Experts 2011" lists Stefan as an expert for labour law.
 
In its latest ranking "WIWO top law firms", Wirtschaftswoche, a leading German business magazine, recommends Stefan as one of the eight leading lawyers for advising management boards, managing directors and senior executives in Germany.
