Practice notes

Alex is a Partner in the Eversheds Finance Group. He specialises in corporate insolvency, debt and equity restructuring and commercial and consumer loan portfolio transactions. He has particular expertise in all forms of UK corporate insolvency regimes and distressed equity and finance restructuring. He has undertaken a number of secondments into commercial teams at banks and regularly speaks at training sessions on the topics of loan sales and debt restructuring for banks and financial institutions.

In addition, Alex has extensive experience dealing with secured, unsecured, commercial and consumer loan portfolio sales and acquisitions, both performing and non-performing. He acts for a wide range of banks, funds and insurers in this sector and has specific expertise in equity release mortgage funding arrangements.

His recent experience includes:

  • acting for the administrators of Norton Motorcycles, leading the legal team dealing with the sale of the business and other issues arising during the administration;
  • acting for life insurance companies in multiple forward-flow funding arrangements for equity release mortgage portfolios including market-leading high street lender arrangements;
  • advising banks and corporate clients in numerous debt restructuring and insolvency situations relating to mid-market distressed corporates;
  • acting on behalf of private equity fund clients in numerous sales and acquisition of loan portfolios, both performing and non-performing and including the project management of extensive diligence exercises;
  • advising the board of a large point of sale marketing business during a multiple phase debt and equity restructuring including dealing with the management incentive programme;
  • acting in the multiple phase leveraged restructure of a food business including an equity reorganisation;
  • acting for a real estate fund in the acquisition of a number of large distressed real estate loans and associated security from a bank including subsequent restructuring and enforcement; and
  • acting for a challenger bank in the acquisition of portfolios of commercial mortgages - leading the transactions and managing the due diligence processes.
