Clive is Head of Water Regulation in our Utilities team, specialising in the water sector.

He has an extensive knowledge of regulatory and operational matters affecting the water industry having spent 20 years working in-house at Severn Trent Water, holding roles as Head of Legal, General Counsel and Company Secretary and 10 years in private practice with a dedicated focus on water sector clients. His experience includes the interpretation and application of statutory provisions governing water and sewerage undertakers, and of their instruments of appointment.

From 2007 to 2009 Clive was Head of Water (UK) at DLA Piper.

During his time at Severn Trent Water Clive was recognised by Chambers as one of the top in-house lawyers in the water industry, and Legal 500 reported that Clive attracts praise for the depth of his experience and knowledge in the water industry.

  • Advising on non-household retail market reform and retail exit
  • Advising on Ofwat investigations using powers under Competition Act 1998 and Water Industry Act 1991
  • Advising on price reviews and IDOKs
  • Advising on use by Ofwat of its financial penalty powers
  • Advising on licence modifications proposed by Ofwat
  • Advising on referrals to Competition Commission and Parliamentary Ombudsman relating to Ofwat’s use of Competition Act powers
  • Dealing with applications for NAVs and responding to third party applications including the negotiation and drafting of necessary agreements
  • Giving evidence to the Competition Commission in relation to a proposed water sector merger
  • Drafting new tariff structures and charges schemes
  • Advising on the transfer of private sewers
  • Handling investigations and prosecutions by Environment Agency and Drinking Water Inspectorate
  • Drafting and implementation of hosepipe bans and drought orders
  • Negotiation and drafting of documentation governing fluoridation arrangements, and representing water industry in discussions with government departments
  • Providing advice on setting up a water supply licensee company
  • Advising on compliance with RAG5 re arms length trading with associate companies
  • Interpretation and application of statutory provisions governing water undertakers, for example: works powers, powers of entry, powers of charging and recovery, water supply and sewerage powers and obligations
