Practice notes

Lerosha is an associate at Eversheds Sutherland in Durban and part of our property department. She has many years of experience in the conveyancing and property field. She commenced her law career in 2003 as a filing clerk at a well reputed Durban law firm and shortly thereafter she was promoted to conveyancing paralegal. In 2007, Lerosha commenced studying towards achieving her Law Degree part-time. She qualified as an Attorney in 2016, as a Conveyancer in 2019 and a Notary in 2020.

Lerosha has been involved in various types of property related work during her career.

Examples of Lerosha’s Property & Notary experience includes:

Conveyancing – including registration of conventional & sectional title property ownership transfers (residential and commercial), residential & commercial mortgage bonds, share block conversion transactions, various conveyancing related applications, consents and endorsements (for example legal entity conversions), changes of name, replacement of lost title deed applications etcetera), subdivision and consolidation transfers, legal entity restructure transactions, divorce transfers and endorsements, deceased estate transfers

Notary – including execution and registration of Antenuptial Contracts, Notarial Tie Agreements, Notarial Bonds, Notarial Deeds of Servitudes and Cancellations thereof, Notarial Leases and Notarial authentication of documents for use outside of South Africa.

Advice in relation to general property and notary matters:

• improved/unimproved land, houses, farms, sectional title, share block, corporate real estate, retail, industrial and commercial properties

• property due diligence investigations (one of which was listed in the top 10 unlisted deals of 2019)

• registration of transactions in all Deeds Offices in South Africa

• opening of sectional title registers and freehold township developments,

• drafting property related preliminary and ancillary documents

• supervision of property transfers on behalf of clients where another firm is handling transfer

• preparation and vetting of various contract, such as sale agreements (Property and Sale of Business); Lease agreements (Residential and Commercial) for clients and providing legal advice

• providing conveyancing and notary services to clients, namely: a listed multinational company, private equity firms, and various private companies and individuals

• listed on Investec Bank Limited mortgage bond referral panel for registration of mortgage bonds

• advice on marital regime contracts

• notarial bonds; notarial deeds; and notarial leases

• notarial authentication of documents
