Practice notes

Adam Nierzwicki is an attorney-at-law in the Labor Law team at Eversheds Sutherland Poland. He focuses on terminations, employment litigation and whistleblowing.

He has over 10 years of experience supporting international and domestic business in HR matters, often including large scale employers who are household names.

Adam’s experience includes managing local, multi-jurisdiction and cross-border HR projects. He gives pragmatic and solution-driven advice for both HR and legal teams to help them overcome labour law challenges and apply most the efficient approach to ER matters.

He advises on multitude of day to day and strategic issues such as contractual employment documentation, working time management, internal policies, performance management, equality, bullying and harassment investigations, data protection, TUPE as well as social insurance matters. He is particularly skilled in handling challenging terminations and employment litigations.

Adam is the author of articles on employment law published in leading Polish business dailies. He is also co-author of the employment blog He is a recognized expert enjoying the trust of clients, as confirmed in the 2021 Legal 500 EMEA directory.

  • Conducting an investigation of bulling allegations made by a former employee against a high ranking manager at a leading global pharmaceutical company.
  • Advising an American software company in connection with restructuring and collective dismissals, including a collective labour dispute and negotiations with trade union on the collective dismissals agreement as well as effective representation of the client in litigation initiated by employees securing favourable result for the client.
  • Advising leading European manufacturer of automotive break systems in a matter of continued application of favourable social insurance premiums after transfer of employees and securing successful court ruling in litigation against the Polish Social Insurance Office. 
  • Advising numerous clients, including world’s leading technology company and ultra-luxury auto maker on successful implementation of emergency measures under anti-COVID-19 laws.
  • Advising leading multinational imaging and electronics company on severance and restrictive covenants terms of a sensitive departure of a key executive.
  • Advising a leading provider of quality assurance and testing of entertainment products on an urgent case of implementation of non-disclosure and restrictive covenants across a large employee population and managing timely delivery of the same product by US, UK and Chilean lawyers. 
  • Advising leading life sciences company on investigation of bullying/harassment allegations put forward by a group of employees against a mid-level manager.
  • Advising the global beverage corporation on remote working regulations and coordinating work of legal teams across central Europe.
