Tom is part of a global team of 320+ lawyers in Eversheds Sutherland’s Financial Services Disputes and Investigations product group (“FSDI”). He helps financial services firms to resolve civil litigation and contentious regulatory issues in a timely and commercial way. His recent experience includes:

     

  • Acting for an indemnifier in a successful claim in unjust enrichment. The dispute arose following payments made by the client under a mistake pursuant to an invoice discounting agreement. The case developed the common law on fetters of contractual discretion in the context of finance, in particular where a party has failed to exercise such discretion properly or at all. Case reported as: BHL v Leumi ABL Limited [2017] EWHC 1871 (QB);
  •  

     

  • Acting for leading financial institutions in a range of complex, high value and strategically important claims involving allegations of breach of contract, breach of statutory duty, professional negligence, undue influence, economic duress, product misselling, and unfair relationships; and
  •  

     

  • Representing firms in response to Financial Conduct Authority enforcement action and providing external support to clients in relation to internal investigations.
  •  

Tom has particular expertise in payment services matters, and was seconded to the Financial Conduct Authority to help draft their policy response to the Payment Services Regulations 2017. He works closely with the firm’s non-contentious Payment Services Group, providing support on contentious and quasi-contentious aspects of clients’ PSD2 implementation projects, terms and conditions, and other compliance issues.

Tom is a member of FSDI’s Digital Group. This is a cross-office working group which focuses on disputes and regulatory issues arising in the context of FinTech and RegTech. He also sits on client service teams for key clients in the firm’s financial institutions group.
