Practice notes

After having worked for global law firms for several years, Merle studied for a masters degree in International Law at the University of Glasgow. After returning to Germany in September 2013, she joined Eversheds Sutherland as Principal Associate in the international employment law department in the Hamburg office. As a certified specialist in employment law (“Fachanwältin für Arbeitsrecht”), she advises German and international companies in all areas of individual and collective employment law, including pension matters. Her work covers both contentious and non–contentious cases.

Merle’s areas of expertise covers the design and implementing of employment contracts, employment and service agreements, remuneration systems, ethics codes, and pension schemes. She also advises on corporate restructurings and transactions, including transfers of undertakings and major redundancies. Merle has considerable experience in advising and supporting clients throughout the whole process, including due diligence regarding the target’s employment conditions; drafting the necessary agreements and documents; advising on implementation; and supporting the standardization of employment conditions.

Merle’s recent pensions experience includes:

  • a number of cases arising from the standardization of employment conditions including pension after a merger of 5 companies 
  • drafting and advising on individual company pension provisions for managing directors and board members
  • advising on the various types of pension schemes available under German law, their risks and advantages and further requirements such as insolvency insurance
  • special challenges pension schemes pose in corporate restructurings and transfers of undertakings
