Practice notes

Fabian is a partner in the Munich office and head of the German insurance practice.

He focuses on the automotive industry, supplier and electronics industry as well as on the pharmaceutical and medical products industry. In addition, he is frequently instructed by insurance companies. He focused on international insurance programmes, personal liability insurance and D&O insurances, on construing policies, insurance covers, the law of reinsurance as well as the insurance procurement law.

Furthermore, Fabian has extensive expertise in international product recalls and matters of product safety compliance, such as the implementation of European standards, the compliance with pre- and post-marketing-obligations of manufacturer and distributors of consumer goods as well as liability prevention. Fabian also has many years’ experience of ordinary courts and arbitration tribunals as well as in proceedings of alternative dispute resolution.

In 2020 and 2018, Fabian has been selected a “Acritas Star Lawyer” by Acritas based on clients’ praise for his matter handling and client focus. Fabian is recommended as a leading product liability lawyer in Germany by Best Lawyers as well as Legal Media Group’s “Guide to the World’s Leading Lawyers”. Furthermore he is recommended for insurance law by Legal 500 Germany and has been awarded a “top lawyer for insurance law” by German business weekly Wirtschaftswoche.

Fabian’s recent experience includes advising and representing:

  • an international D&O Insurer on the defence of a German-style class action (KapMuG proceedings) against former board members of a large German bank
  • various manufacturers and distributors on global product recalls (up to 60 countries)
  • on the defence and pursuing subrogation claims on recall cost reimbursement
  • various US/European retrocessionaires in international arbitration
  • a foreign reinsurer on establishing branch in Germany and setting up distribution channels
  • captives of Global Corporates on notification and publication requirements following transfer of business, and regarding regulatory requirements for a foreign investment
