Duncan is a Legal Director specialising in financial services disputes and contentious regulatory issues.
Duncan advises on all aspects of financial markets disputes including disputes involving alleged breaches of mandate, breaches of investment restrictions, suitability, investment advice and mis-selling. He also regularly advises investment banks and brokers on issues arising out of the closing out of clients' positions, termination and default of derivatives trades, asset tracing and international enforcement. Recently, he has represented banks in on a range of claims and associated regulatory investigations related to the sale of RMB-USD FX Accumulator products.
He regularly acts on behalf of both international banks and senior employees in relation to a range of regulatory inquiries and investigations, including matters related to alleged manipulation of benchmark indices, mis-selling of regulated products and market manipulation. Most recently, this work has included advising clients in relation to regulatory investigations connected to market manipulation and investment product suitability as well as assisting a client respond to an ICAC dawn raid.
Duncan has a particular interest in the development of cybersecurity regulations in Hong Kong and elsewhere, from both a contentious regulatory and a compliance perspective. He is an active member of Eversheds Sutherland’s global Cybersecurity and Data Privacy team and regularly publishes articles and speaks at external events on these issues.
Duncan is admitted as a solicitor in Hong Kong, England & Wales and Ireland.
