Practice notes

Dr. Christine Wilhelm is a Counsel in our Munich office and member of the Employment and Labour Law practice group.

She focuses on providing advice to medium-sized and listed companies in all employment and labour law matters including representing them in and out of court in litigation cases.

In addition to strategically supporting restructuring processes (transfers of business/closures of business) and the associated personnel planning (relocations/(mass)dismissals), Christine is experienced in choosing and implementing selected management instruments, such as performance reviews, bonus/target agreements, reference letters, (written) warnings and/or relocations, as well as in the coaching of line managers required for this purpose. In addition, Christine has profound knowledge and many years of experience in applying psychological negotiation methods in challenging situations, such as mobbing, staffing, addiction and pathological personality disorders.

Another part of her daily business is contract management. In addition to general templates, Christine drafts tailor-made employment and service contracts including the required supplementary agreements (bonus, gratification, company car agreements etc.) for employees of any hierarchical level. In this context, she particularly focusses on the selection of flexible working time models (flexitime, trust-based working time, working on call) as well as the implementation of mobile work/home office and job sharing.

At company level, Christine drafts company agreements as well as general company rules. Christine is just as familiar with the negotiation and implementation of matters under works constitution law vis-à-vis the works council as with the court order and/or conciliation committee proceedings required in this regard. She has extensive experience in introducing corporate integration management systems.

Christine’s recent experience includes:

  • Successful defence in a lengthy anti-discrimination case involving a significant compensation claim against a company of the public sector organised under private law due to the dismissal of an employee based upon the individual's Scientology membership
  • Successful representation of an internationally operating group within the framework of accusations regarding the illegal supply of temporary workers
  • Support and advice to a group operating throughout Europe regarding company-internal investigation measures for the detection of staffing
  • Detection of and mediation in a mobbing case within a media company operating throughout Bavaria
  • Development and drafting of a job-sharing agreement for female executives as a "novelty" on the executive management level of a national consulting firm
  • Expert opinion on the question of whether a transfer of business exists in case of the public awarding of contracts for security controls at German airports for an internationally operating group
