Practice notes

Jocelyn is an Associate in our Asia Litigation and Dispute Management Group and a member of our international Competition, EU and Trade Group. She is a disputes lawyer by training, with particular experience in regulatory and arbitral proceedings, and is specialising in competition, regulatory and public law.

Jocelyn has practical experience of defending clients in investigations conducted by the Hong Kong Monetary Authority (HKMA) and the Hong Kong Stock Exchange (HKSE), including representing them in compulsory interviews and settlement discussions (in English, Cantonese and Mandarin). She also regularly advises Hong Kong public authorities on the application of statutory rules and in relation to Hong Kong High Court judicial reviews. With solid experience of advising clients from both sides of the bench, Jocelyn has been described by clients as a well-rounded practitioner who “understands how regulators think” and is particularly well positioned to guide clients through regulatory enquiries.

As well as advising clients on dispute resolution, Jocelyn also advises clients on all aspects of regulatory, commercial and competition law as it applies to their trading practices and commercial agreements in Hong Kong, the PRC and the EU. She has advised clients on a wide range of issues, including behavioural competition issues, compliance, routes to market, merger control and trade-related controls. She also regularly assists international clients with trade-related regulatory reviews, covering sanctions and import and export controls applicable in Hong Kong and Mainland China. She has recently returned from a six-month secondment at our Competition, EU and Trade team in London, where she gained practical experience of advising on EU and UK competition law and trade-related disputes. She obtained the Postgraduate Diploma in EU Competition Law from King’s College London in 2018.

Examples of Jocelyn’s recent experience include:

  • Defending the Hong Kong regulator of broadcasting and telecoms in Hong Kong High Court judicial review proceedings and advising it on issues affecting the industries, including the application of the rules against anti-competitive conduct.
  • Advising one of the largest global kitchenware brands on its supply agreements across Asia, acting for it in the defence of PRC court proceedings brought against it by its PRC-based supplier and representing it in arbitral proceedings at CIETAC, Beijing.
  • Acting for a PRC power generation company regulatory proceedings conducted by the HKSE in relation to the company’s non-compliance with the Hong Kong Listing Rules and successfully reaching a full and final settlement with the HKSE on its behalf.
  • Acting for various global banks in investigations conducted by the HKMA and representing their business personnel in compulsory interviews.
  • Advising Hong Kong conglomerates in various sectors on competition law compliance of their joint ventures and collaboration and conducting competition law compliance training for their business divisions.
  • Advising one of the world's largest container shipping lines on the merger control implications of its joint venture with a PRC state-owned enterprise in the marine services sector and defending it in regulatory proceedings in China.
  • Advising a PRC-based conglomerate on a HKD 5 billion worth disposal of a budget airline to an international airline and successfully secured unconditional clearance from competition authorities in a number of jurisdictions in Asia.
  • Advising a global manufacturer of aerospace communications products on regulatory issues arising from its distribution arrangements in Asia on a regular basis, with a particular emphasis on compliance with import and export control laws.
  • Advising a Hong Kong-based conglomerate on the application of various sanctions and import & export control regimes to the global freight management business of its subsidiaries.

Jocelyn is a regular contributor to legal journals and practitioners’ guides and has recently co-authored the Hong Kong chapter on Dominance for the 2017, 2018 and 2019 editions of Getting the Deal Through.
