Aghini is a Senior Associate in our Litigation team and handles civil and commercial matters before the Courts of Mauritius. She also has experience in in all aspects of intellectual property law.

Aghini Goinden is an Attorney-at-Law who joined our office in December 2018 following one year of pupillage at Dentons Mauritius LLP. 

She deals in several areas such as civil and commercial law, intellectual property, insolvency, bankruptcy and family law. Aghini’s day-to-day work consists of drafting of power of attorneys, judicial and extra-judicial documents, drafting of pleadings and preparation of cases for matters before the Courts of Mauritius (District Courts, Industrial Court, Intermediate Court, Supreme Court) and Tribunals. She also regular appears before the Courts of Mauritius and is well conversant with the procedures in Mauritius.

She also advises extensively on intellectual property law matters and can assist you in protecting and registering your trademarks, patents, utility designs, industrial designs and copyrights in Mauritius and enforcing your intellectual property rights in case of infringement of such rights. She is well known for her expertise in intellectual property and protects and enforces not less than 100 famous international brands for the leading pharmaceutical companies, alcohol beverages companies, multinational consumer goods companies, multinationals specializing in luxury goods and motor vehicles amongst others. She has hands-on experience in all aspects of intellectual property protection and enforcement, ranging from simple or contested registrations, invalidations, litigation before the Industrial Property Tribunal and the Supreme Court. 

Whether you are a domestic firm or a foreign firm, Aghini accompanies you in the whole process of registration starting with conducting a trademark search at the Industrial Property Office in Mauritius to determine the availability of the proposed trademarks and whether your proposed mark(s) is/are identical and/or similar to existing registered marks in Mauritius. Keeping the interest of the clients as top priority, she advises clients on the viability of their proposed trademarks.

Foreign applicants usually require a trademark agent in Mauritius to file their application for registration. Since Aghini is a legal practitioner, you can grant her a Power of Attorney and she will act as your agent in Mauritius. Aghini helps in drafting the Power of Attorney and do the needful for the local registration for it to be valid in Mauritius.

Aghini also assists you in filing application for registration of your trademarks at the Industrial Property of Mauritius and advises on the classes under which you can register your trademarks. In case there is any opposition to your application for registration, Aghini assists in drafting and filing counter statements. Similarly, if any person/firm in Mauritius attempts to register a mark similar or identical to your mark, Aghini assists in drafting and filing Notice of Oppositions. Over the years, Aghini, has acquired experience in dealing with matters before the Industrial Property Tribunal. She attends hearings and make representations on behalf of clients before the Industrial Property Tribunal.

She also helps in making timely applications for renewal of application for registration of marks so that the client does not incur surcharge fees for late renewal. If your registered mark has been removed from the registers owing to non-renewal, Aghini helps you to restore the said mark by making the relevant applications to the Industrial Property Office. She also provides client with a range of services such as applications to record change of name and address, change of ownership of the intellectual property, assist in drafting deed of assignment and licences.

Aghini is also able to offer you services such as customs enforcement of your intellectual property rights (border protection), requests to conduct raids, assist in civil and criminal actions, sending cease and desist letters/notices to infringers, assist in drafting and concluding settlement agreements (re-export or destructions), initiate appropriate legal actions before the relevant courts of Mauritius to protect your intellectual property rights in Mauritius.

Aghini provides legal assistance to individuals in Mauritius who obtain legal aid under the Legal Aid Scheme to be a party to civil proceedings. Aghini also regularly advise on family matters (divorce, immediate care and control, custody and alimony) and make representations on behalf of clients in family matters before the Supreme Court of Mauritius (Family Division).
