Emily Paisley is an Associate in our Dispute Resolution and Litigation team, who assists businesses resolve disputes at an early stage.
Emily has worked as a dedicated litigation solicitor since qualifying in 2016, with a particular interest and experience in commercial litigation, and joined Eversheds Sutherland in 2021 as an Associate in our Dispute Resolution and Litigation team.
Emily can advise you on a broad range of litigation matters, to include debt recovery, insolvency, construction, intellectual property and real estate litigation. Emily also has experience in judicial review, environmental health and safety, regulatory enforcement, gaming, education and disability discrimination within the service sector.
A large part of Emily’s role is helping businesses like yours assess the merits of pursuing or defending a breach of contract claim, taking into account the existing business relationship or market pressures, and devising a strategy based on the bespoke needs of your business. Emily can also assist with reviewing your terms and conditions, or credit control procedures, to limit the number of claims, or the uncertainties, which might arise in same.
Emily has acted for a number of insurers, defending claims against the insurer for failure to pay out under the various policies, and also household insurance claims for personal injury amongst other claims.
With the disruption caused to the hospitality industry over the past few years Emily has been dealing more frequently with licensing queries and applications. The first phase of changes to the licencing laws have come into force, and Emily will keep a close eye on the implementation of this and will be available to guide and advise you as required.
In her spare time she enjoys running, hiking and open water swimming.
- Advising a local client with a growing international business in a transatlantic dispute which incorporated defamation and intellectual property aspects.
- Helping a FCA regulated client with its portfolio of debts, to include pre-litigation action to ascertain if the Debtor is a mark, enforcement action to include insolvency proceedings and obtaining legal charges against the Debtors’ property.
- Assisting in the pursuit of a minority shareholder action for unfair prejudice, seeking to force the purchase of the shares and/or wind up the company in question.
- Representing a number of FCA regulated clients with their asset recovery books in relation to the breach of individual and commercial hire purchase agreements.
- Acting for a number of high-profile insurer clients in relation to proceedings involving disputes about coverage, and defending claims brought against their Insured’s home insurance policies.
