Phil is an Associate in our Dispute Resolution & Litigation department with considerable experience as a commercial litigator.

Phil increasingly specialises in commercial court cases and mediation, with a focus on complex real estate (landlord and tenant disputes), white collar crime, Judicial Review proceedings and shareholder/contractual disputes as well as contentious building and construction related disputes. Phil has gained an increasing reputation as a go-to up and coming commercial disputes lawyer in these areas, where his works ranges across a diverse range of issues such as advising on claims for defective work, advising property developers on judicial review applications and planning law, commercial landlord and tenant disputes and debt collection and enforcement matters. Phil also advises US entities on the enforcement of foreign judgments in Ireland.

Phil is a member of the Investigations and Risk Management Group, and the White Collar Crime cross-border initiative.

Phil’s recent experience includes:

• Advising a large property developer, as landlord, in relation to a dispute with its tenant over non-payment of rent in relation to a historic Dublin café.

• Acting for the owner and director of a Dublin based company in relation to a shareholder dispute valued at approximately €20 million.

• Defending the liquidator of a construction company on foot of a very significant claim being brought by the receivers relating to alleged damage caused to a large apartment block in Dublin. The claims and alleged losses are for just under €50 million.

• Acting for a large property developer in commercial court proceedings related to the ownership of stained glass windows valued at in excess of €1.5 million.

• Acting in proceedings before the High Court and Court of Appeal in judicial review proceedings related to building heights in Dublin city centre.

• Advising one of the world’s largest multinational technology companies in relation to a significant number of potential contractual disputes involving a range of users of one of its online platforms.

• Represented and advised a consumer finance business in respect of many complex and heavily contested appeals including a high profile High Court Judicial Review case involving complex European consumer and banking law issues.

• Acting in relation to the defence of High Court proceedings involving a contractual dispute valued at approximately €7 million for a commercial semi-state airport company in Ireland.

• Acting for the developer of a medical centre on a significant claim in excess of €1,000,000 for professional negligence against the design team including negligence in providing engineering and architectural services.

Phil adopts a practical, strategic and solution driven approach to the matters he acts in and is well respected and trusted among clients.

Phil has also published ‘Navigating the Process of Discovery: A Review and Refinement of the Guiding Principles’ (Lexology, 2019).
