Practice notes

Felicity is an associate in the Financial Services Disputes and Investigations team. Felicity specialises in pensions litigation, including disputes relating to the funding of pension schemes, the construction and rectification of trust documents, breach of contract and professional negligence claims.

Felicity trained and qualified with Gowling WLG in the Pensions team where she advised employers and trustees of occupational pension schemes on a variety of contentious issues. Since joining our firm, Felicity has continued to build and expand her disputes practice and experience, working with clients and counterparties to reach practical solutions to their issues.

Felicity’s recent experience includes advising the trustee of a pension scheme on applying to the courts for directions regarding the validity of the scheme’s trust documentation giving the trustees power to grant discretionary increases to pensions in payment and deferment, acting for the trustee of the Thales UK Pension Scheme in Part 8 proceedings to determine the appropriate construction of pension scheme rules in terms what rate of indexation should be applied in Scheme’s plan ([2017] EWHC 666 (Ch)), acting for the trustee in a rectification claim worth an estimated £500m, advising on a professional negligence claim brought against the scheme’s former actuarial advisers, administrators and pensions consultants, arising from a defective pension scheme equalisation, and handling regulatory investigations, including relating to moral hazard and requests for information from the Pensions Regulator.
