Practice notes

Elizaveta Belotserkovskaya is a senior associate in our dispute resolution and commercial practice groups. Elizaveta’s primary focus areas are commercial litigation, arbitration, mediation, and the law of obligations.

Besides representing clients in courts at all levels and in various regions of the Russian Federation, Elizaveta advises on a wide range of matters under contract law, which is her major field of professional and academic interest. Combining her expertise in contract law and commercial dispute resolution, Elizaveta drafts agreements containing tools for the comprehensive protection of clients’ interests in the event of potential future disputes with their counterparties. Elizaveta also regularly participates in projects of our corporate and M&A practice groups.

Elizaveta’s recent experience includes:

  • prepared an appeal to the Russian Constitutional Court to review several provisions of the Russian State Commercial Procedural Code and legislation on arbitration
  • represented Wärtsilä Vostok in court and bankruptcy proceedings against а counterparty which violated its obligations to pay for works performed under a works and services agreement
  • represented foreign investor in several interconnected court proceedings related to the termination of a joint investment project for the construction of a multi-apartment residential real estate and infrastructure project in the Moscow region
  • represented a client in mediation proceedings conducted at the Chamber of Commerce and Industry of the Russian Federation (negotiations, drafting mediation agreement, affirmation of the signed mediation agreement in court)
  • advised and provided full legal support to a Nordic food producer with respect to the sale of its real estate assets (a land plot with a former factory) in Saint Petersburg
  • represented a foreign investor in multiple proceedings against the Federal Service of State Registration, Cadastre and Cartography for Moscow region
  • represented client, the recognized leader in the global diamond mining industry, in arbitration under the Arbitration Rules of the Arbitration Institute of the Stockholm Chamber of Commerce
  • advised a significant number of clients on arbitration clauses for M&A/Corporate agreements
  • advised a subsidiary of the largest German developer in a number of disputes concerning the annulment of an arbitral award / request to refuse recognition of an arbitral award
  • provided legal advice to a Nordic bank with respect to the impact of US sanctions on its relations with clients in Russia
  • advised a US company on the termination of partnership agreement on the construction and operation of commercial real estate in Saint Petersburg
  • advised a Norwegian firm on the termination of an agency agreement under Russian law
  • advised a significant number of clients on force majeure issues and the application of various remedies for breach of contract due to spread of COVID-19 in Russia

In 2018, Elizaveta participated in Eversheds Sutherland’s secondment program and was seconded to our office in London, UK.

Elizaveta is a frequent speaker at events held by Legal and Investment Committee of the American Chamber of Commerce in Russia.

She also regularly speaks at seminars and conferences on a wide range of legal issues. Some of her recent presentations and seminars include:

  • a keynote on recent developments in arbitration law in Russia at a meeting of the professional association of international oil and gas investors (2019)
  • a seminar on preventive protection of a company’s most important assets (namely, its brand, customers and property) at X International Youth Legal Forum, a satellite event of the St Petersburg International Legal Forum held by Saint Petersburg State University together with the Russian Association of Lawyers (2019)
  • Elizaveta spoke at roundtable discussion on sanctions, counter-sanctions and their economic and legal effect at the ‘Russian Law Week in London’ organized by the Law Society and the Bar Council of England and Wales in partnership with the Russian Federal Chamber of Lawyers, the Moscow Chamber of Advokats, the St Petersburg Chamber of Advokats, the Anglo-Russian Law Association, and the British Russian Law Association (2018)
  • She participated at a ‘Ladies in Arbitration’ event at Eversheds Sutherland Finland together with Finland Arbitration Institute, where she gave a presentation on arbitration in Russia (2017)
