Jonathan Scott

Associate

Jonathan is an Associate in the construction and engineering group in our London office. He has experience of all forms of dispute resolution including adjudication, litigation and arbitration.

A construction and engineering associate within Eversheds Sutherland's Litigation and Dispute Management group, Jonathan can advise construction companies like yours across the full spectrum of construction and engineering law. 

This includes advice throughout the full life-cycle of a construction project, whether it be in the funding, procurement, execution or post-completion phase. 

A large part of Jonathan's role is helping clients understand their rights and obligations under their agreements. He regularly provides project advisory advice to parties seeking to avoid a dispute. 

Jonathan's recent arbitration experience involves working on disputes with Eversheds Sutherland colleagues based in Dubai, Washington, Qatar and Hong Kong. He is familiar with arbitrations conducted under the rules of all of the major arbitration institutions, but in particular the ICC and LCIA rules. 

Outside of advising clients, Jonathan frequently produces articles on topical areas which are relevant to you. 

Jonathan's recent experience includes:

  • acting for a contractor client as respondent in LCIA proceedings in relation to the supply, installation, operation and maintenance of a gas power plant (€50 million claim; English law, seat Zurich)
  • advising European contractor client in bringing claims relating to power plants located in Myanmar: preparing key strategic advice for client team; advising on commencing arbitration proceedings and assisting in resisting bond calls (c. €10 million; ICC; bespoke form of contract; Finnish law)
  • acting for major multinational contractor in defending ICC arbitration proceedings brought by their local sub-contractor relating to an infrastructure dispute in the middle east. Key responsibilities included preparing pleadings and interim injunctions; engaging and instructing experts; preparing Terms of Reference for and advising on appointment of the Tribunal (c. $50 million, ICC, Qatari law; seat Doha)
  • successfully defending Qatar National Bank in reported High Court proceedings commenced by a Nigerian bank seeking to set aside a $20 million LCIA arbitral award under s.68 of the Arbitration Act
  • advising FTSE-250 asset management company in its dispute with major UK construction contractor relating to a mixed-use site in the UK. Key tasks included preparing pre-action protocol letter before action, drafting standstill agreements, engaging and instructing experts and advising client on all stages throughout (JCT form of contract c. £30 million)
  • advising a UK-based employer client in relation to defects and prolongation costs arising out of two biomass conversion projects in the UK (£300 million)
  • advising a FTSE-250 developer client in relation to a defects claim at an industrial warehouse valued at £50 million
