Shaun is an Of Counsel with the International Arbitration, Litigation and Dispute management group. Shaun focuses on commercial disputes in common and civil law jurisdictions and provides representation and strategic advice for clients engaged in international commercial arbitration and dispute resolution at international commercial courts.

Upon graduating with First Class Honours from the National University of Singapore, Shaun served in a judicial capacity as a Magistrate and Assistant Registrar of the Supreme Court for five years, where he published several notable written judgments on international arbitration law. The decisions include Firstlink Investments v GT Payment on the applicable law governing an arbitration agreement, and Titan Unity, endorsed by the Singapore Court of Appeal, on the threshold to determine the existence of a valid arbitration agreement.

Shaun was the Head of the Court of Appeal Section in the Supreme Court Registry, and was in charge of the management of complex commercial appeals, such as the arbitral dispute in PT First Media TBK v Astro Nusantara International BV. He worked on the establishment of the Singapore International Commercial Court (SICC) as Secretariat to the SICC Committee, where he was involved in the formulation of the rules and procedure of the Court.

Shaun is an accredited International Arbitrator and Mediator of the Global Mediation and Conciliation Network.

Shaun’s experience as Counsel includes representation in high value international disputes include the following:

  • Emergency Interim Relief – Successfully represented a global energy client in an Singapore International Arbitration Centre (SIAC) Emergency Arbitration in obtaining emergency relief to protect and preserve the client’s assets in a multi-million dollar commodities dispute.
  • Energy disputes – Successfully represented a global client engaged in supplying energy products for breaches committed by an Indonesian company of the client’s exclusive entitlement to coal mined in Indonesia in an SIAC arbitration.
  • Contractual termination disputes – Successfully represented one of the world’s largest Japanese car manufacturers in an alleged breach of a nation-wide distributorship agreement in an SIAC arbitration.
  • Joint Venture contract disputes – Successfully represented global bank as respondent to alleged claims in breach of Joint Venture agreement and economic torts arising from an unsuccessful entertainment development project in Thailand, for an SIAC arbitration.
  • Banking litigation – Managing Associate for a Singapore court dispute for a Japanese bank where the claimants sought payments arising from mandatory convertible bonds issued by clients. The work includes strategic advice and legal analysis on enforcement aspects in various jurisdictions.
  • Investor State disputes – Worked directly with Queen’s Counsel on the dispute between Reliance Industries, BP and the Government of India over revisions in gas prices and amends to cost recovery provisions of a Production Sharing Contract over an offshore gas block in the Bay of Bengal.
  • Licensing and warranty disputes – Successfully represented one of the world’s largest Japanese car manufacturers in a Japan Commercial Arbitration Association arbitration. The Middle Eastern claimant alleged failure to assist with fulfilling licensing requirements, and alleged breach of warranties.
  • Crisis Management, class action and mass tort product liability claims – Shaun, together with Korean law firm Kim & Chang, represented a global healthcare company in a crisis management case in South Korea. He was substantially engaged in all aspects of legal and strategic work around the case; including work on mass civil claims filed by victims, mediation, settlement and compensation, forensic investigations work in cooperation with Korean authorities, criminal defence work in relation to charged individuals, and strategic / legal advice re communications with media and political stakeholders.
  • Construction – Shaun has experience in major cross-border constructions disputes, including a dispute over alleged delays in supplying defective products and services in relation to the manufacture of electrical houses (pre-fabricated field auxiliary rooms) in support of a Middle Eastern Power and Oil Refinery Project; claims for outstanding payments due from the building of power plants in India; and claims for rectification works necessitated by alleged negligent designs from a German company.
  • Regulatory and Compliance – Shaun has experience in compliance issues in the APAC region. He worked on licensing issues and compliance aspects relating to banking regulations in Indonesia and Japan for a Japanese bank and an Indonesian subsidiary. Shaun has in addition advised on Singapore MAS regulations.

Shaun is a contributing author to two leading texts, the Singapore International Arbitration Law and Practice (2nd Ed), and the Singapore Civil Procedure ("The White Book”), in charge of the chapters relating to international arbitration, Singapore arbitration and the SICC.
