Practice notes

Justin practices in the area of construction and infrastructure law and is particularly familiar with the Building and Construction Industry Security of Payment Act (the ‘SOP Act’). He has represented several clients in adjudications under the SOP Act and made several achievements in this area.

Justin successfully argued the landmark case of Audi Construction Pte Ltd v Kian Hiap Construction Pte Ltd [2018] SGCA 4 before the Court of Appeal. The appeal considered the interpretation of payment clauses vis-a-vis the SOP Act, waiver and estoppel in the context of adjudication, particularly regarding the situation in which a party would be considered to waive a jurisdictional objection. The Court’s decision was reported in the local press and materially affects all parties going through adjudication under the SOP Act.

Justin has also represented construction companies in civil litigation. In 2017, Justin successfully defended his client against a sub-contractor’s lawsuit over allegations of unpaid claims in G-Art Design & Build Pte Ltd v Hong Xu International Construction Pte Ltd [2017] SGDC 37. In that case, he was able to prove that his client had suffered from large losses due to the sub-contractor’s premature termination. Despite the sub-contractor appealing to the High Court, Justin was able to persuade the High Court to dismiss the sub-contractor’s appeal.

Justin has also given talks on adjudication under the SOP Act over the last 3 years, and has contributed to the Society of Construction Law (Singapore) and Singapore Law Blog.

Justin graduated from Queen Mary and Westfield College, University of London in 2011 with a Second Class Honours (Upper). He was called to the Singapore Bar in 2013.
